By accepting this contract, you declare:
- That you are of legal age and have the capacity to enter into contracts;
- That you have read and accept these general terms and conditions. (hereinafter, "the General Terms and Conditions") govern the legal relationship arising from the contracting processes carried out between users-clients (hereinafter, "the Clients") of the legal services website located at the URL http://www.stimme.es owned by STIMME, S.L. (hereinafter "www.stimme.es"). Customers accept the General Conditions from the moment they use or contract the service or purchase any product. This document may be printed and stored by Customers. www.stimme.es provides Customers with the email address info@stimme.es so that they can raise any questions they may have about the General Conditions.
2. Applicable rules
These General Terms and Conditions are subject to the provisions of Law 7/1998, of 13 April, on General Contract Conditions, Law 26/1984, of 19 July, on General Protection for Consumers and Users, Royal Decree 1906/1999, of 17 December 1999, regulating Telephone and Electronic Contracting with general conditions, Organic Law 15/1999, of 13 December, on the Protection of Personal Data, Law 7/1996, of 15 January, on the Regulation of Retail Trade, and Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce.
If you reside outside Spain and Spanish legislation does not apply under your legislation, you may not contract the services or products of www.stimme.es.
3. Modification of the General Terms and Conditions
www.stimme.es may modify the General Terms and Conditions by notifying Customers sufficiently in advance, in order to improve the services and products offered through www.stimme.es. By modifying the General Terms and Conditions set out on the www.stimme.es website, this duty of notification shall be deemed to have been fulfilled.
In any case, before using the services or purchasing products, the General Terms and Conditions should be consulted.
4. Description of products and services
Products from www.stimme.es that are purchased through our website may be returned within seven days of receipt of the order. Only products in their original condition will be accepted for return. The offer of products on www.stimme.es is valid indefinitely and may be modified, rectified or cancelled without prior notice to regular or occasional users and consumers. The civil liability of www.stimme.es for the products supplied is limited to the amount of the products themselves. the user or consumer waives the right to claim any liability from www.stimme.es for any reason in any case of dissatisfaction with the products purchased on this www.stimme.es, as well as possible failures, slow access or errors in accessing the Website, including loss of data or other information that may exist on the computer or network of the user accessing www.stimme.es.
5. Intellectual property
The content provided by www.stimme.es is subject to intellectual and industrial property rights and is the exclusive property of STIMME, S.L. or the individuals or legal entities indicated. By purchasing a product or service, www.stimme.es does not grant the purchaser any right to alter, exploit, reproduce, distribute or publicly communicate said product or service, with www.stimme.es reserving all such rights. The transfer of the aforementioned rights shall require the prior written consent of www.stimme.es. The customer may not make such content available to third parties. Intellectual property extends not only to the content included on www.stimme.es, but also to its graphics, logos, design, images and source code used for its programming.
6. Use of the service and responsibilities
www.stimme.es does not guarantee the permanent availability of its services and is exempt from any liability for possible damages caused by the unavailability of the service due to force majeure or errors in the data transfer networks beyond its control.
www.stimme.es is not responsible for the content of links to other websites that are not owned by it and which, therefore, cannot be controlled by it.
The customer acknowledges that the information provided by www.stimme.es through its services is not of a legal nature and is offered for informational purposes only.
The consultation service is offered for informational purposes and has expressly limited effects, as documents that may be relevant are not reviewed and complete information is not available in any case, making it a limited opinion subject to better rights. In all cases, it is recommended that you consult a solicitor before making any decision with financial implications.
7. Privacy and personal data protection
By providing their email address or other personal data, which is necessary for contracting certain services, Customers give their permission for these addresses to be processed and also used to send commercial communications promoting or advertising the services and products offered by www.stimme.es.
www.stimme.es provides Customers with the email address info@stimme.es so that they can revoke their consent.
www.stimme.es declares that it complies with current regulations regarding data protection, in particular Organic Law 15/1999, of 13 December, on the Protection of Personal Data and Royal Decree 994/1999, of 11 June, which develops the aforementioned organic law. www.stimme.es provides Customers with the means of contact referred to in the previous paragraph so that they may exercise their rights of access, rectification, cancellation and opposition guaranteed by current legislation.
8. Applicable legislation and competent jurisdiction.
These General Terms and Conditions shall be governed by and interpreted in accordance with Spanish law.
9. Notifications
All notifications, requests, petitions, and other communications to be made by the parties in relation to these General Terms and Conditions must be made in writing and shall be deemed to have been duly made when they have been delivered by hand or sent by ordinary post to the other party's address or email address, or to any other address or email address that each party may indicate to the other for this purpose.
10. Nullity and ineffectiveness of clauses
If any clause included in these General Terms and Conditions is declared, in whole or in part, null and void or ineffective, such nullity or ineffectiveness shall affect only that provision or the part thereof that is null and void or ineffective, with the General Conditions remaining in force in all other respects, and such provision, or the part thereof that is affected, shall be deemed not to have been included.
11. Delivery times
Orders placed through www.stimme.es will be delivered within the time frame indicated during the purchase process and, in any case, within the maximum legal period of thirty (30) calendar days from the date of order confirmation, unless a different period is expressly indicated for specific products.
Delivery times are approximate and may be affected by factors beyond the control of www.stimme.es, such as logistical incidents, product availability, force majeure, or circumstances attributable to the carrier.
12. Shipping
Shipments will be made to the address provided by the Customer during the purchase process. It is the Customer's responsibility to provide a correct and complete address. www.stimme.es will not be responsible for delays or inability to deliver due to incorrect or incomplete information provided by the Customer.
Shipping costs
Shipping costs are calculated for each shipment made and always based on the taxable amount (excluding VAT) of the order. The current rates are as follows:
- Orders up to €100 taxable value: €6 shipping costs.
- Orders from €100 to €250 taxable value: €10 shipping costs.
- Orders from €600 to €800 taxable base: €20 shipping costs.
- Free shipping for orders over €800 taxable base per shipment.
Shipping costs will be shown in detail before the purchase process is completed.
13. Returns
All products purchased through www.stimme.es may be returned within fifteen (15) calendar days from the date of invoice, provided that the product and its original packaging are in perfect condition, unused and with all accessories, manuals and original documentation included.
Returns of products that show signs of use, damage, tampering, or are not returned in their original packaging will not be accepted, except in the case of defective or non-compliant products.
To make a return, the Customer must first notify www.stimme.es by email at ventas@stimme.es, indicating the order number and the reason for the return.
Except in cases of defective products or errors attributable to www.stimme.es, the costs incurred in returning the goods shall be borne by the Customer.
14. Right of withdrawal
In accordance with current consumer and user protection regulations, the Customer has a period of fourteen (14) calendar days from receipt of the product to exercise their right of withdrawal, without the need to provide justification.
To exercise the right of withdrawal, the Customer must notify their decision unequivocally to www.stimme.es, by email to ventas@stimme.es, indicating their identification details and order number.
Once the withdrawal has been exercised, the Customer must return the product in perfect condition, unused and in its original packaging. The return costs shall be borne by the Customer, unless the return is due to an error or defect attributable to www.stimme.es.
www.stimme.es will refund the Customer the amount corresponding to the returned products, using the same payment method used for the purchase, within a maximum period of fourteen (14) calendar days from receipt of the returned product or from the date on which proof of return has been provided.
The right of withdrawal shall not apply in the cases provided for by law, including, among others, when the products are personalised or made to the Customer's specifications.
